The Lake Mary Township monthly meeting was called to order by Chairman, James Schmidt, with the pledge to the flag at 7:00 pm.
Members present: Supervisors: James Schmidt, Donna Hoeper, and Pete Fernholz;
Clerk, Sue Hanson, and Treasurer, Christy Tvrdik.
A Motion was made by James Schmidt to approve the agenda, 2nd by Donna Hoeper. Motion carried 3-0.
A Motion was made James Schmidt by to approve the claims and disbursements #5659-5672, 941-2021-2, and PERA0721 in the amount of $60,512.90, 2nd by Pete Fernholz. Motion carried 3-0.
A Motion was made by Donna Hoeper to approve the 2021 minutes with punctuation correction, 2nd by James Schmidt. Motion carried 3-0.
A Motion was made by Donna Hoeper to approve the minutes of the Subordinate Service District for the Lake Andrew Third Addition hearing, 2nd by James Schmidt. Motion carried 3-0.
TREASURERS REPORT: LMT has a balance of $965,008.26 There are no outstanding checks. The tax settlement was deposited on June 30th, Christy will need to transfer approximately $77,542.46 into one of the ICS accounts. A motion was made by James Schmidt to approve the Treasures report as read, 2nd by Pete Fernholz. Motion carried 3-0.

ROAD DISCUSSION:
Swing away mailbox supports/ Pospisil Dr. The Swing Safe mailbox support systems were installed on June 9th on the remaining tar roads.
Dean & Delores Matthies, residents, on Pospisil Dr., were present regarding issues of their Swing Away mailbox installation. They believe employees from the company hired by LMT to install the mailbox supports, Alvero, must have unplugged their lake pump causing damage to their garden and lawn. The Mathies are seeking monetary compensation for their garden, lawn, and also for their existing mailbox post that had been installed in approximately 2017 and damaged during the removal. The Matthies stated that they were out of town from June 4th until the late evening of June 9th, and determined on the morning of June 10th that their lake pump had been unplugged. James Schmidt spoke to an Alvero representative and they assured him that none of the workers would do something of that manner, also the time frame of the installation would have been in the mid-morning of June 9th, which would mean that if the installers, in fact, would have unplugged the pump, the water would have been off for less than 24 hours until it was discovered. After discussion, it was determined it was highly unlikely their lake pump was unplugged by Alvero and happened by some other source. Some options were discussed regarding their mailbox post, including possibly fixing it. A motion was made by Donna Hoeper to table a decision regarding their mailbox post to the next meeting, 2nd by Pete Fernholz. Motion carried 3-0. Another letter was received from a Pospisil Dr. resident regarding the Swing Away support.
Letter from LaGrand Township/ West Lake Mary Rd: An email and photo were received from LaGrand Township regarding tar breaking up on West Lake Mary Rd on the west end (not in the 114 right of way). A motion was made by James Schmidt to have LaGrand Township repair West Lake Mary Rd. as recommended and LMT will reimburse them, 2nd by Pete Fernholz. Motion carried 3-0.
Road repair Little Mary Circle: A motion was made by James Schmidt to bill PAZ excavating for fixing the dip on the road on Little Mary Circle where the tar had been cut into for sewer connection for new construction, 2nd by Pete Fernholz. Motion carried 3-0.
Hummingbird Way: A motion was made by James Schmidt to rescind the motion he made at the May meeting to repair Hummingbird Way, 2nd by Donna Hoeper. Motion carried 3-0. A new motion was made by James Schmidt to do a full-depth reclamation and overlay with Riley Brothers Construction for the original bid of $129,485.20 plus an additional $1,000.00 to cover the increase of oil cost and have Runge Grading do the sub cutting for the project at an approximate cost of $21,000.00, 2nd by Donna Hoeper. Motion carried 3-0.
OLD BUSINESS:
ARPA Money application: Applications are now being taken for ARPA funding. A motion was made by James Schmidt to have Sue Hanson apply for the ARPA funding for LMT, stating the LMT proposed budget for 2020 was $371,768.00, 2nd by Pete Fernholz. Motion carried 3-0.
Big Foot Resort: The LMT Board does not have any concerns with the Big Foot Resort variances.
- Fisher (Schnuckle) Oriole Ln-Easement takeback: LMT received information from lawyer, Paul Johnson, concerning the easement takeback. The information from the lawyer stated: If some township residents wish to vacate a part of Oriole Lane and determine title to the underlying land, the best approach for them to take is to apply to the District Court under Minnesota Statute section 505.14. Under this statute, the court can vacate part of a public road and decide the title/ownership of the vacated road. The process includes filing an application with the court, giving the required notice by publication and posting with service on the town board chair, and a court hearing. Assuming the court agrees that the vacation is appropriate, the court then issues a judgment vacating that part of the road and awards the title of the land underlying the vacated road to the appropriate adjoining landowners. If a landowner claims that the vacation will damage his property in some way, the court can, if appropriate, also award damages. James Schmidt has passed this information on to the landowner. A discussion was had.
Serenity Ln. Culvert: The plastic culvert on lot 9 of Serenity Ln. has been replaced with a galvanized culvert.
NEW BUSINESS:
Lawyer: A discussion was had to change the lawyer for LMT to Michael Cass, with the Swenson Lervick Law Firm. A motion was made by James Schmidt to engage Michael Cass as the LMT lawyer, 2nd by Donna Hoeper. Motion carried 3-0
Gracie’s Addition/ Oriole Ln: A discussion was had, no concerns at this time.
Thistles Bluebill: A complaint regarding thistles on Bluebill Dr. has been looked into and taken care of.
Land use/sewer permits: LUP was reviewed and discussed.
Calendar: July and August calendars were reviewed and discussed.

MAILBAG- Mailbag was reviewed and discussed.
