Lake Mary Township Monthly Meeting
November 13, 2018
Meeting was called to order by James Schmidt with the pledge to the flag at 7:30 pm.
Motion made by James Schmidt to approve agenda, 2nd by Donna Hoeper. Motion carried 3-0
Motion to approve the bills in the amount of $9,792.93 made by James Schmidt. 2nd by Pete Fernholz.

Motion to approve minutes with corrections to verbiage and punctuation made by Donna Hoeper, 2nd by James Schmidt. Motion carried 3-0
Treasurers report given by Christy Tvrdik. There are 2 outstanding checks in the amount of $2,464.64. Christy went over interest rates from Bremer. Money market is at 1.86% and a 2 year CD is at 2.86%. Discussion was had. James Schmidt made a motion to transfer .5 million dollars form the capital improvement sewer fund into a 24 Month 2.86% CD with Bremer Bank, and leave the remainder of $186,814.98 in the Money Market. Pete Fernholz 2nd. Motions carried 3-0.

ITEMS FROM THE FLOOR: None
ROAD DISCUSSION: Jeff Runge Sr present. Majority of the grading of gravel roads is complete. More grading may be done if weather warms up enough to allow it to be done. Riley Brothers did not get to fixing gator spots, due to running out of time and inclement weather. Roads will be on work list with Riley Brothers for the spring of 2019.
OLD BUSINESS:
Robin Lane- Several residents of Robin Ln present and Lake Mary Township Lawyer, Paul Johnson, was also present to review process of making the private part of Robins Ln into a township road. There are three processes that can be done to achieve this. The easiest way to do this is all the residents owning land on either side of the road are in agreement and join together in a document prepared by lawyer to convey the township easement to the road. The other ways are the 2 legal ways of statute. One is a process of an application filed with the town clerk, all residents again, need to be in agreement, the Town Board then either accepts it or not. There are no damages paid by the township for the road being approved, as the road is not up to town road standards. The final way is a petition process. This is where every landowner is not in agreement with the easement right. The petition would be prepared and eight people in neighborhood would need to be in agreement and sign it. There is a process with notices and a public hearing, the Board then needs to decide if they want to take over the road. Damages also need to be looked at as they are essentially condemning the roadway and the township would have to pay the damages for of the fair market value of the land with or without the road being there. Discussion was had on how road and land values effect taxes, residents would need to check with County Assessor to see if a new road will affect property taxes. Janice Johnson, who spoke for the Robin Ln residents, stated Robin Ln is in a Wetland area and the DNR has a waterfowl easement off of Robin Ln which needs to be maintained. Discussion was had on Waterfowl easement. When should be checked on if DNR will allow work on the road due to this. It was stated that residents have private easements, but they are not listed on map. The road would need to be brought up the Township specifications. In order to do this the whole road would need to be ripped up and redone and brought up to the County standards of being a 7 ton road. It would need reconstruction of 1900 square lineal feet with 6 inches of aggregate surfacing over that. There would need to be at least one new culvert put in and 66 feet of right away. Ditches need to be made and inspections need to be done during the process. This reconstruction would need to be paid by property owners. Lake Mary Township would take care of the cost of a turnaround. Once up to standards, Lake Mary would take over maintenance of the road. A rough estimate of the cost of the road would be $65,000.00. Discussion was had about the possibility of doing the road as a special assessment on the property owner’s taxes. Best interest for residents would be to try a do road in a process where they could spread payments out over time.
Culvert Resolution: Board looked over resolution and made some changes, Sue Hanson will retype and present at December Meeting for approval.
NEW BUSINESS:
Revised County Sewer Ordinance: Douglas County has redone the sewer resolution.
5 acres or more- no sewer compliance needed for outbuilding which is not connected to a house, but sewer needs to be no older than 20 years or has had a compliance inspection within 20 years.
Anderson sewer variance: Homeowner will not be connecting to ALASD sewer, as do not have easements to get across properties needed for hook up. Property owner will be installing a private sewer.
Calendar: Need to review and discuss deadlines, etc. at each meeting.
Newsletter: Will be done by Treasurer, Christy Tvrdik, Deputy Treasure, Julie Freier will assist with this. Newsletter will be put on January agenda to discuss changes.
File cabinet: Another fireproof file cabinet will be needed in near future. Sue Hanson will check on options and cost.
Computer: Office computer is running slow. James Schmidt suggested bringing computer into Computer Specialists to be looked at and antivirus installed. Motion made by James Schmidt, that in case computer is beyond repair, we can spend up to, but not over $1500.00 on new computer. Pete Fernholz 2nd. Motioned carried 3-0
